Introduction
Welcome to Clear Cut. These Terms and Conditions govern your use of our real estate photography and videography services. By booking a shoot or using our website, you agree to comply with these terms in full. These Terms and Conditions also include our cancelation policy, licensing, payments, and protection for you as the client, and our company Clear Cut. The "Last Updated" date at the bottom of this page will indicate when these Terms were most recently revised. Please read them carefully before proceeding with any orders.
Services
Clear Cut provides professional media services for residential and commercial real estate listings, including HDR photography, virtual tours, floor plans, and drone footage. We reserve the right to modify our service offerings and pricing at any time without prior notice. We reserve the right to update, modify, add, or discontinue services and pricing at any time. Changes will not affect services that have already been confirmed unless otherwise agreed. The client may request that certain rooms, features, or areas be photographed or filmed; however, we do not guarantee that every requested image or shot will be captured or included in the final deliverables.
User Responsibilities
Clients are responsible for ensuring properties are shoot-ready at the scheduled time. This includes cleaning, decluttering, and providing access. Clear Cut photographers are not responsible for moving furniture or cleaning assets during the appointment. Clients are responsible for providing accurate information when scheduling a service, including the property address, contact information, requested services, and any relevant details about the property. We reserve the right to decline, reschedule, or cancel a booking when reasonably
necessary. The client is responsible for securing or removing personal, valuable, fragile, private, or sensitive items before the session. The client is also responsible for ensuring that we have safe and reasonable access to the property at the scheduled time.
By booking our Services, the client represents that they have the authority to grant us access to the property and permission to photograph or film it. The client is responsible for obtaining any permissions, approvals, releases, or consents required from property owners, tenants, occupants, homeowners' associations, or other applicable parties. The client agrees to indemnify Clear Cut against claims resulting from the client's failure to obtain required authorization or permission, to the extent permitted by applicable law.
Payments
Current pricing may be displayed on our website or otherwise provided to the client. Additional services, special requests, travel fees, extended shooting time, or other circumstances may result in additional charges. Payment is due upon delivery of the images or as specified in the service agreement. We accept all major credit cards and electronic transfers. Late payments may be subject to additional fees and temporary suspension of services. A booking is not considered fully confirmed until FOR EXAMPLE: "THE APPOINTMENT HAS BEEN ACCEPTED AND CONFIRMED BY US"]. We reserve the right to withhold delivery of final photographs, videos, or other deliverables until all outstanding amounts have been paid in full.
Cancellations & Rescheduling
Cancellations made less than 24 hours before the scheduled shoot time may incur a cancellation fee. We offer a first-come, first-serve rescheduling system. Weather-related rescheduling will be handled on a case-by-case basis at the photographer's discretion.
Intellectual Property
Clear Cut retains the copyright to all media delivered to the client. The client is granted a non-exclusive, non-transferable license to use the media for marketing the property for sale or rent. Any other use requires written permission. Payment for Services does not automatically transfer copyright ownership of the photographs, videos, or other media to the client. We grant permission to clients to use and share this content for EXAMPLE: MARKETING AND PROMOTING THE PROPERTY FOR SALE OR LEASE, MLS LISTINGS, REAL ESTATE WEBSITES, AND SOCIAL MEDIA. Using our copyrighted content in connection with knowingly false, misleading, or defamatory statements about our company may result in further legal action where applicable.
"WE DO NOT GUARANTEE LONG-TERM STORAGE OF DELIVERED FILES." We will offer temporary storage and time to download your content. This time frame can be anywhere from 2 weeks, to at most a month. We can not guarantee any time over two weeks, and expect all clients to download their content before the two week limit.
Unless otherwise agreed upon in writing, Clear Cut may use photographs, videos, and other media created during a session for its portfolio, website, social media, advertising, promotional materials, competitions, and other lawful business purposes.
If you wish to request that certain media not be used for promotional purposes, please contact us at Support@clearcut.biz before the session or as soon as reasonably possible.
Limitation of Liability
Clear Cut shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid by the client for the specific service in question. Nothing in these Terms is intended to limit liability where such limitation is prohibited by law.
Our website may contain links to third-party websites or services. We do not control and are not responsible for the content, availability, privacy practices, or policies of third-party websites. Any use of third-party websites or services is at your own risk and subject to their applicable terms and policies.
We make reasonable efforts to keep our website available and functioning properly. However, we do not guarantee that the website will always be available, uninterrupted, secure, or free from errors.
Governing Law
These terms are governed by and construed in accordance with the laws of the jurisdiction in which Clear Cut operates. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the local courts.
